Terms of Service

1. Acceptance of Terms

By creating a Leadova account or using the Leadova platform, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our service. These Terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Service

Leadova provides an AI-powered marketing automation platform including lead scoring, audience segmentation, email campaign management, WhatsApp messaging, and AI content generation for businesses across multiple industries including SaaS, E-Commerce, Hospitality, Healthcare, and Real Estate.

3. Account Registration

When creating an account:

• ·You must provide accurate and complete information
• ·You are responsible for maintaining the security of your account credentials
• ·One account per person or business entity
• ·You must be at least 18 years old to create an account
• ·Business accounts represent that the registrant has authority to bind the organization to these Terms
• ·You must notify us immediately of any unauthorized account access at security@leadoraa.com

4. Acceptable Use

You agree NOT to use Leadova to:

• ·Send spam, unsolicited messages, or bulk communications to recipients who have not opted in
• ·Upload, transmit, or distribute malware, viruses, or harmful code
• ·Attempt to reverse engineer, decompile, or extract source code from the platform
• ·Use the platform to harass, harm, or discriminate against individuals or groups
• ·Violate any applicable laws, including CAN-SPAM Act, GDPR, CASL, or other anti-spam regulations
• ·Import contacts without obtaining proper consent as required by applicable law
• ·Resell, sublicense, or provide unauthorized access to Leadova to third parties
• ·Scrape or extract data from the platform in an automated manner beyond normal use

5. Subscription & Payment

• ·Subscriptions are billed monthly or annually in advance, depending on your chosen billing cycle
• ·No refunds for partial months — plans are active until the end of the billing period
• ·Prices may change with 30 days written notice to your registered email address
• ·Failed payments will result in account suspension after a 7-day grace period
• ·You may downgrade your plan at any time; downgrade takes effect at the next billing cycle
• ·All prices are in USD unless otherwise stated

6. Free Trial

• ·14-day free trial with full Growth plan features — no credit card required
• ·One trial per business entity (creating multiple accounts to extend trial access is prohibited)
• ·Trial accounts have the same feature access as the Growth paid plan
• ·We reserve the right to end trials at our discretion with 48 hours notice
• ·After trial expiry, your account reverts to the Starter plan or you may choose to upgrade

7. Data & Privacy

• ·You own your data — Leadova does not claim ownership of your contacts, campaigns, or content
• ·We process your data as a Data Processor as described in our Privacy Policy
• ·You are responsible for obtaining proper legal consent from your contacts before importing them
• ·You must comply with all applicable data protection laws (GDPR, CCPA, etc.) in your use of the platform
• ·You may export all your data at any time from the Settings page

8. Intellectual Property

• ·The Leadova platform, brand, logo, and underlying AI models are our sole intellectual property
• ·You retain full ownership of content you create using Leadova (emails, campaigns, copy)
• ·AI-generated content: you own the output produced for you; we own the models that produced it
• ·You grant Leadova a limited license to process your data solely to provide the service

9. Limitation of Liability

• ·Leadova is provided "as is" without warranties of any kind, express or implied
• ·We are not liable for lost revenue, lost profits, or indirect, consequential damages
• ·Our total liability to you is limited to the fees you paid in the last 3 calendar months
• ·We do not guarantee specific marketing results, lead conversion rates, or revenue outcomes
• ·We are not liable for third-party service outages (Stripe, OpenAI, Twilio, etc.)

10. Termination

• ·You may cancel your subscription at any time from the Billing page — no cancellation fees
• ·Your account remains active until the end of the current billing period after cancellation
• ·We may suspend or terminate accounts that violate these Terms, with or without notice
• ·Upon termination, you have 30 days to export your data via the Settings page
• ·After 30 days post-termination, all data is permanently and irreversibly deleted

11. Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Country/State]. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the applicable arbitration rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
